Terms & Conditions

Before hiring from Midlands Roof Box Hire, please read the Terms & Conditions below, which explain the responsibilities of both the hirer and Midlands Roof Box Hire throughout the booking and hire period. They cover the use and professional fitting of our Roof Boxes, compatible Roof Rack Hire, payments, collection and return, vehicle suitability, cancellations, damage and other important conditions. These Terms & Conditions apply to equipment hired from Midlands Roof Box Hire. Please read them carefully before making a booking. They explain the hire agreement, fitting and use of equipment, payment responsibilities, cancellations, damage, insurance and the return process.

1. Definitions

“We/Us/Our” means Midlands Roof Box Hire.

“You/Your/Hirer” means the person or business entering into the hire contract.

“Equipment” means all items supplied for hire, including roof boxes, roof bars, mounting kits/feet, keys/locks, fittings, tools and accessories.

“Hire Period” means the dates on your booking confirmation.

“Security Deposit” means a refundable amount held against loss or damage (see Section 10).

2. Contract Formation

A binding contract is formed when we issue written booking confirmation by email or message after receiving:

  • Your completed booking details; and
  • Full payment and any Security Deposit.

We may refuse a booking if the vehicle or intended use is unsafe or unsuitable.

3. Eligibility & Identification

The Hirer must be at least MINIMUM AGE, e.g., 21 and hold a valid UK driving licence.

Proof of ID and address may be required, for example photo identification together with a utility bill or bank statement dated within the previous three months.

We reserve the right to cancel the hire if eligibility checks fail. See Section 11 for refunds.

4. Vehicle Suitability & Safety

It is your responsibility to ensure your vehicle is suitable for the Equipment, for example by having suitable factory rails, fixing points or compatible door apertures.

The maximum permissible load is the lowest of:

  • The vehicle roof load limit stated in the manufacturer’s handbook;
  • The roof bar load limit; or
  • The roof box load limit.

You must never exceed the applicable maximum load.

You must take the increased height of the vehicle into account and avoid unsuitable height-restricted areas, including car parks, barriers, drive-throughs and ferry access points.

We may refuse fitting or cancel the hire if we believe the proposed use would be unsafe.

5. Fitting, Handover & Checks

Unless otherwise agreed, we will fit and remove the Equipment at the beginning and end of the Hire Period or at a scheduled appointment.

We will provide a brief demonstration and a Handover Checklist recording:

  • The items fitted;
  • The apparent condition of the Equipment;
  • Key numbers; and
  • The measured overall vehicle height.

If you are fitting the Equipment yourself, you must follow the manufacturer’s instructions and torque specifications. You accept responsibility for correct fitment and the periodic checks described in Section 6.

You must tell your motor insurer that a temporary roof box and/or roof bars will be fitted where your policy requires notification.

We do not insure your vehicle or the contents carried in the Equipment. See Section 12.

6. Use of Equipment and Your Responsibilities

While using the Equipment, you must:

  • Drive smoothly and allow for crosswinds;
  • Allow appropriate stopping distances;
  • Follow the lower of the legal speed limit or the manufacturer’s recommended maximum speed for the roof box or bars;
  • Stop safely after the first 20–30 minutes of driving and at regular intervals afterwards to check that clamps, straps and locks remain secure;
  • Keep the Equipment locked when unattended;
  • Remove keys from locks when the Equipment is unattended;
  • Distribute weight evenly;
  • Secure contents to prevent movement;
  • Avoid carrying loose liquids, animals, illegal materials or hazardous materials;
  • Avoid off-road use or use in extreme conditions beyond normal road use;
  • Not modify the Equipment; and
  • Not remove serial numbers or identification labels.

7. Hire Period, Collection & Return

The Hire Period is stated on your booking confirmation.

Collection and return will take place at [LOCATION / POSTCODE] or in accordance with [Delivery & Collection Service terms and fee if offered].

Late returns may be charged at £5 per day or at the applicable daily hire rate and may forfeit any applicable grace period. See Section 10.

8. Charges & Payment

You agree to pay all applicable:

  • Hire charges;
  • Fitting, delivery and collection fees where applicable;
  • Security Deposit;
  • Late return charges;
  • Cleaning charges;
  • Loss charges; and
  • Damage charges.

See Section 10 for further information concerning deductions.

Payment is due on booking unless otherwise agreed in writing.

Prices include VAT where applicable. We will provide a VAT invoice if registered.

9. Care, Loss & Damage

You are responsible for the Equipment from the point of handover until it has been returned and inspected.

You must take reasonable care to prevent damage, including scratches or impact damage caused by overloading or contact with garage doors, barriers, branches or other objects.

Lost keys: Lost keys will incur a £30 replacement charge per key or lock set, together with any related call-out costs.

Water ingress: Roof boxes are weather-resistant but are not guaranteed to be completely watertight. You should pack your belongings accordingly.

10. Security Deposit, Inspection & Deductions

We will inspect the Equipment when it is returned.

We may deduct reasonable sums for:

  • Damage beyond fair wear and tear, including cracks, gouges, broken locks, broken hinges, bent bars or damaged feet;
  • Missing items such as keys, clamps, fittings, adapters or instructions;
  • Cleaning where Equipment is returned heavily soiled, subject to a £30 cleaning fee; and
  • Late return charges as described in Section 7.

Where damage prevents the Equipment from being immediately rehired, we may charge the lower of:

  • Our repair cost or the current replacement cost, less fair wear; or
  • The manufacturer’s fixed component price where applicable.

Evidence of the relevant cost will be provided on request.

11. Cancellations & Refunds for Consumer Bookings

Our standard cancellation terms are:

  • More than 7 days before the start date: full refund less a £10 administration fee.
  • 3–7 days before the start date: 50% of the hire fees will be refunded.
  • Less than 72 hours before the start date: hire fees are non-refundable.

If we are able to rehire the Equipment for the same period, we will refund you the lesser of the charges above or the loss actually incurred.

Distance bookings: If you book online or by telephone, the Consumer Contracts Regulations 2013 may provide a 14-day cooling-off period. However, where the hire is due to begin within 14 days and you request performance to start, you agree that the service is supplied immediately and the usual right to cancel without charge does not apply.

12. Insurance, Accidents & Incidents

We provide the Equipment for hire only. We do not insure your vehicle or the contents of the roof box.

You should ensure your motor insurance covers the use of roof boxes and roof bars where applicable.

In the event of an accident, theft or other incident you must:

  1. Ensure everybody is safe;
  2. Notify the police where required;
  3. Inform your insurer where appropriate; and
  4. Notify Midlands Roof Box Hire as soon as reasonably practicable.

Do not continue to use damaged Equipment. Contact us for guidance.

13. Liability

We are responsible for loss or damage you suffer where that loss or damage is a foreseeable result of our breach of these Terms or our negligence.

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud or any other liability which cannot legally be limited or excluded.

We are not responsible for:

  • Wear to your vehicle’s paint or rub strips arising from normal and correct use;
  • Indirect or consequential losses;
  • Loss of or damage to contents carried inside the roof box; or
  • Losses caused by your failure to follow instructions, exceeding load limits or failing to secure items correctly.

Our total liability for any other losses is limited to the hire charges paid for the affected Hire Period.

14. Your Right to Use the Equipment & Our Right to Repossess It

You have a right to quiet possession and use of the Equipment during the Hire Period, provided the Equipment is used in accordance with these Terms.

We may end the hire and recover the Equipment if:

  • You materially breach these Terms; or
  • We reasonably believe the Equipment is at risk.

15. Force Majeure

We are not liable for delays or failure to perform due to circumstances beyond our reasonable control, including severe weather, accidents or supply issues.

If our performance is affected, we will offer a refund or revised dates where possible.

16. Data Protection and UK GDPR

We process your personal data for purposes including:

  • Administering bookings;
  • Managing security deposits;
  • Providing safety or recall notifications; and
  • Meeting legal and accounting obligations.

Our lawful bases include performance of the contract and legitimate interests.

We retain essential records for up to [5 years] and share personal information only with necessary processors, such as payment providers.

You have rights including access, rectification, erasure and restriction, together with the right to complain to the Information Commissioner’s Office.

17. Complaints

If we cannot resolve your complaint, you may seek alternative dispute resolution. Nothing in these Terms affects your statutory rights.

18. Governing Law & Jurisdiction

These Terms are governed by the laws of England & Wales and the courts of England & Wales shall have exclusive jurisdiction.

19. Changes to These Terms

We may update these Terms from time to time.

The version applicable to your booking is the version in force on the date we confirm your booking.
